This declaration of consent (“Consent”) sets forth certain terms and conditions relating to the Non-Resident Nepali Association National Coordination Council of USA (“NRNA NCC-USA”) election (“NCC Election”), and such terms and conditions are hereby accepted in their entirety by the NRNA NCC-USA members, voters, nonvoters, nominees, candidates, supporters, representatives, and any other person concerned (“Parties”), which click the “I consent” link or provide any information to NRNA NCC-USA relating to the NCC election, thereby consenting to such terms and conditions and entering into a binding agreement between the PARTIES and NRNA NCC-USA.
The Parties declare that any and all information they provide NRNA NCC-USA relating to the NCC election, whether by completion of an NRNA NCC-USA election form, any document attached thereto, or otherwise, is true and complete in all respects to the best of the Parties’ knowledge and belief. Eligible voting members and/or candidates (“EVMCS”) for the NCC election certify that they are NRNA NCC-USA members in good standing pursuant to NRNA NCC-USA bylaws, rules and policies. Further, the EVMCS, by clicking the “I consent” link, e-signing this or any other NCC Election form, nominating a candidate for the NCC election or accepting such nomination, or voting in this election, electronically or otherwise, do affirm the terms of this Consent and all other NRNA NCC-USA bylaws, rules and policies.
The Parties hereby acknowledge having read all pertinent NRNA NCC-USA bylaws, policies, and any State and Federal laws that govern this NRNA NCC-USA election. The Parties acknowledge and declare that they understand and accept all such NRNA NCC-USA bylaws, rules and policies, and any State or Federal laws that may apply to any activity relating to this NCC Election.
The EVMCS acknowledges that falsifying or omitting any information provided to NRNA NCC USA relating to the NCC election, whether by completion of an NRNA NCC-USA election form, any document attached thereto, or otherwise, may result in NRNA NCC-USA taking immediate action against the EVMCS pursuant to, NRNA NCC-USA bylaws, rules, and policies, or any pertinent State or Federal laws. The candidates for the NCC election (“Candidates”) acknowledge, consent to, and authorize the NCC election commission and its members to verify the Candidates’ eligibility and the information the Candidates provide to NRNA NCC-USA relating to the NCC election.
The Parties hereby release, discharge, and hold harmless individually and collectively NRNA NCC-USA and its board members, NCC election commission and commission members, membership verification committee, and their agents, successors, or assigns, including all other voting or nonvoting members, agents, organizations, professionals, volunteers, or representatives of NRN NCC-USA, from and against any and all claims, damages or assertions of liability that may arise, directly or indirectly, now or in the future by reason of or in connection with the election process or an election decision, action or omission relating to the NRN NCC-USA election commission’s administration of the NCC election.
The Parties acknowledge and consent that Candidates elected through the election process, shall take NRNA NCC-USA’s oath of office, and abide by all applicable NRNA NCC-USA bylaws, rules, and policies. However, whether or not a particular Candidate is elected, the Parties agree to accept the outcome of the election and abide by all applicable NRNA NCC-USA bylaws, rules, and policies. The Parties agree that they will make no claims against the NCC election commission and any of its members regardless of any election result, or for any potential harm or claim relating to the election process.
The Parties further acknowledge and consent that the role of the election commission is limited to the administration of the NCC election in a manner consistent with NRNA NCC-USA bylaws, rules, and policies, and the election commission and its members will in no way be responsible for any election result, including the performance of any EVMCS in the NCC election. Therefore, the Parties acknowledge and consent that the NCC election commission and its members will not be liable for any potential harm or damages relating to the election process.
